You're kidding me right?
Buy it now is the perfect example of prior art and obviousness. Many auction houses selling items such as collectibles, horses, computers, will take a phone call from a potential buyer who guarantees a price before auction. this is a negotiated pre-sale. Merc doesn't have any patent to this, the patent office just issues patents in technology because they don't understand the idea that technology is about making the obvious simpler.
