If it was, they'd prosecute it that way.

Theft is synonymous with larcency.
"Under the common law, larceny is the trespassory asportation and taking of the tangible personal property of another with the intent to deprive him or her of it permanently."

Note the words "tangible", "deprive", and "permanently". If you "steal" a copy, you have not deprived the owner of the original.
Thus you need a seperate crime because listening/watching a copy of a song/film doesn't fit the definition of larceny (ie theft).
Even if it did by some torturous logic, it would be *petty* theft, and RIAA/MPAA wouldn't be entitled to $750,000.00 for "stealing" a song that cost 99 cents, right?
So naturally the entertainment industry doesn't normally pursue theft of their property--baring the odd theft of an actual theatre film or sound equipment...
Oh, and just so I finish this pet peeve on a high note, historically pirates were thieves since they didn't take *copies* of gold dubloons...
