If there was no law then why the court case?
I don't know much about Roe v Wade only heard it meantion in a few movies. What was the case about? Besides the obvious.

Anyway back to the point. If there is no law a case can end up in civil court. In that court a judge can rule in what they see as fair to settle a dispute between two parties. The descretion with no law is left to the judge. Then case law gets set. Basically other judges look to what the first judge ruled to make thier rulings. This can all happen in the absence of laws.

A law isn't made here and any time another judge can rule differently if an good enough argument is presented. Now if a law is created that supports a judges decision it becomes law the judge can not rule against the law. They can however interperet the law and rule accordinglly which will also set case law.

So judges don't make laws. The make descision based on laws and interperet those laws. In the abesence of a law they are very free to rule how they feel is fair. Case law just makes the job easier and a decision based on case law is less likely to be over turned in appeal.
