- Privacy in a Public Place

While there have, in the past, been rulings in the highest courts that there is no reasonable expectation of privacy in a public place, this tends to apply only to situations where no INCOME is made from the images captured. Should they be for Art, and not sold, or for free informational purposes, than one would indeed be hard pressed to sue successfully.
Because Google has made no secret of the fact that every "Free" service they provide is something with which they seek to use every technological advantage to gain income, it would be interesting to argue that Google does NOTHING for free, but indeed they expect to make money off of the existence of these images and so at least owe those photographed some manner of compensation.
Google would be left arguing that they merely, out of philanthropic generosity, were giving access to their "Street Level View" for public benefit and were making no money as a consequence of these actions. Good luck to THAT!
