I-Spy, You Spy...
So what it boils down to is that neither of the currently proposed bills appear to be necessary in the war on malware. This project was doomed from the start, of course, as I noted on my own blog (http://technologycurmudgeon.blogspot.com) nearly a year ago. Whatever finally gets passed will be just as effective in combating malware as the "CAN SPAM" act was in stopping spam. Expect it to be filled with goodies for various special interests as well.

Ultimately, of course, the fault for all this lies with We, the People. WE elected these clowns in the first place. Or we boycotted elections altogether, thereby guaranteeing that special interests would ruls the day. Either way, the solution is to get involved with the political process.
