I'm not really sure that copyright laws themselves have gotten tougher in the last 2 years. Can you think of any new ones that have passed in that time? The DMCA is much older, as are the NET laws. Anyone?

I would like to see a new law here, one that's better written than what we have now, as it legally allows YouTube to do what they're doing, and I don't think they should profit from infringement.

They should have, but they still haven't done this. Not a single case has gone to trial. Not one. They've either settled, or dropped the lawsuit when someone threatened to go through with the case. Sad, as it exposes their lack of evidence and fairly flimsy attempts at extortion.

This one is less of a no-brainer than your previous claims (that WMA would replace MP3 as the standard, that Plays-For-Sure would replace iTunes within one year). It's an open question, and I'm very curious to see how a judge rules. If YouTube is not covered by Safe Harbor laws, we're going to see a flurry of new lawsuits against all sorts of companies. Should be interesting.
