Can you explain further why you think this is a strawman argument?

The Safe Harbor provision was put into the DMCA at the request of many very powerful and wealthy companies, companies that are important to our nation's economy. The idea was that ISP's would not be held responsible for the crazy actions of their subscribers. Like Verizon wouldn't be in trouble if a DSL subscriber spread hate speech on his web page. Or that AOL couldn't be sued if Joe User subscribed through them and used his internet connection to download music illegally. That's why it's there.

Do you think this is a bad thing? Should ISP's get sued for millions of dollars for being complicit when someone downloads music on a p2p network? Is that what you're saying here?
