What you also ignore......
That it is legal to use a small clip or excerpt from a copyrighted work, WITHOUT permission, as long as the excerpt is referenced. I can take a quote from a book if I'm writing a book review. That is perfectly legal. The same law covers a short clip from a video.

Whether the author of the video post states that the clip was used from XYZ, is a different story and may be arguable. Showing the complete copywrite work without permission is illegal, but there is no easy way to know if that permission was given or not, except when asked to remove the offending media.

That is the point the poster was making. You can't really know, 100% positively, that permission was given, or who posted it.
