Tic is right. If it's a video on You Tube then obviously it's copyrighted. The question is is it authorized? You can't tell that by looking at it.

Heck, your post is copyrighted. How can ZDNet tell if it's your copyrighted work or if it's someone elses that you lifted? By looking at it?

Going back to You Tube, even if it's a clip from "Lost," how does You Tube know that it isn't posted by a viral marketer with permission from Fox (or whoever)?

Even if it's a clip from "Lost," how does You Tube make the legal judgement that it's use isn't fair? If the poster provides text saying "this is my favorite scene from last night's "Lost" episode," does that constitute criticism and fair use?

If anything, the safe harbor provisions make it more likely that a fair use is going to be taken down. That girl's "Lost" criticism is coming down as soon as Fox (or whoever) complains.
