They should ban the user
I'm in agreement with you here. YouTube should ban any user uploading infringing material. I don't think it will be effective, as people will just open another account under a different name, but I would like to see this enforced as well.

I think you misunderstand my motivations here, by the way. I'm not a big fan of YouTube, and do not think they should be able to profit from infringement. However, as a law abiding citizen, given the way the laws are written, I don't think they're doing anything illegal. That's why I keep calling for better written laws to be passed which would take them down. Scrap the DMCA, start over, and write something up to date and specific.

But, as I have repeatedly said, your call for them to somehow magically spot infringing material is asking the impossible. How can you tell? How do you know who holds the copyright? If you see a Shakira video, does she hold the copyright? Her record company? The director of the video? What if she's switched record companies? What if one company sells her contract to another? Is it an authorized video posted for promotional purposes?

With no central repository for copyright, there's no way of ever knowing. Here's a thought--how about if you want your copyrighted work protected, you have to fill out a form identifying yourself, the work in question and your contact information. You'd pay a small fee to do this (a few dollars). Then, places like YouTube would have an index to check against. If you can't be bothered to sign up for the index, then courts aren't going to do much if you're infringed against. Sure would make everyone's lives easier.
