That's fine with me. The DMCA is horribly written and has many unintended consequences. If we could get Congress to scrap it and start over, we'd all be better off.

Once again, you are 100% wrong and horribly uninformed. Under the Berne Convention, every single video on YouTube is "copyrighted". Duh. The display of copyrighted material by YouTube is not a problem. The problem is when the copyrighted material is used without the permission of the copyright holder.

I will ask you for at least the tenth time now, how YouTube can "easily" determine who holds the copyright on a given piece of footage, and whether they've given permission for its inclusion.

Here's a quick test for you. I pulled a random clip after a search for the word "skateboard":

Please "easily" tell me if this clip infringes. Is it an amateur video, or is it something pulled from a commercial skateboarding tape? Who is the copyright holder? Did the person who posted it have the permission to post it? There's music used in the clip, did they receive permission to use that music? Who holds the copyright on that music?

If you can't answer these questions, then how do you expect Google to do so?
