If you know it's stolen
You're operating under the assumption that YouTube knows that a particular upload is copyrighted by someone other than the uploader. They don't review each upload to see if its copyrighted, and even if they did, how would they know that the copyright holder didn't upload it?

And YouTube doesn't charge anyone to host their videos. Its revenue is completely ad based, but no ads appear on the vidoe page itself, giving YouTube an out, albeit a shaky one, that they don't make money if a video happens to be copyrighted.

As the law is currently written, all they have to do is take down copyrighted videos when notified by the copyright holder. So far, it appears they haven't broken any laws.
