Keep on saying it then. It proves nothing
I am sure that Google did their homework. As it stands, the DMCA doesn't require Google to monitor the content, but rather the copyright holder has to notify Google of the offending material. There is also the concept of Fair Use.

As it stands, according to the law, Google has a good case in that the law and the DMCA are in their favor. It would be a legal presidence that found for or against Google anyway, which is what think Google is looking for. This isn't the only legal battle that Google is fighting either.

It might turn out that the foresight of educated management at Google might just win these battles and really get the chairs flying at Microsoft.
