---It should be the other way around...youtube should not be able to post content UNTIL the copyright holder has given permission.---

How would you find the copyright holder? Let's say I upload a brief clip from a movie from 1937. The producers are all dead and the studio that made the movie is out of business. How will you know who owns copyright and how will you contact them?

Let's say I upload a home movie of people dropping Mentos into Coke bottles. How would you know who owns the copyright to that home movie? What if it's something I swiped from someone else's website?

There is no place where one can go and look up the copyright on things. What you're proposing is impossible.

Actually, under the DMCA, the burden is on the copyright holder. You may not agree with the law, but that's the law.
