Here's why you're wrong
If you paid Intuit with the promise that things would go smoothly then they should deliver what they promise. If the IRS does not flex on this issue then Intuit should cover whatever financial losses their customers incurred by placing their faith in their system. Otherwise Intuit is facing a serious, probably irreparable, reputation problem and they will lose their market share.

Also your theater analogy is flawed. In this case the person is at the movie theater 30 minutes before the listed showtime but the line to get in is so long and slow that you don't make it to your seat until after the start of the movie. In this case, it IS the theater's fault for not managing the flow of people.
