You're right that the web must be used intelligently to gather information. However if a candidate has written a weblog highly critical of his former employer, has posted pictures of drinking binges at which inappropriate acts have taken place or is a supporter of political causes that violate or support the violation of labor laws or other laws why would an employer hire such a person?
In the above example if the person's resume lists that company, the individual is quite recognizable due to photograph then there will not be much doubt.
Also don't forget that in the real world most people never find out why they have not got a job. Was it a poor interview, more qualified candidate or did the employer see something online he did not like? the perspective employee will never know.
