As to "paint your toenails and wear women's underwear," that falls in the category of "gender identity and expression." While that is not covered nationwide, some states do consider firing/refusing to hire someone for that to be discrimination. Washington, DC definitely has that in its own laws, and I know there are other states as well. Sexual orientation isn't protected in all states. In 33 states you can be fired or refused employment based on your sexuality. The Employment Non-Discrimination Act (ENDA) is meant to ban employers from considering sexual orientation in employment decisions.
