Not to disagree, but....
While I agree with your standpoint completely, there is quite a difference between what should be and what is. While there may be no legal foot to stand on using web presence in determining employability, I sincerely doubt that any employer would actually state that as the reason for not tendering a job offer. The standard form letter stating, "we found a candidate whose qualifications better suited the position" would be all you receive. Certainly not, "We saw you post on your blog that you support X, and therefore are not offering this job to you."

The point of the article is that you should be aware of your online (and therefore, public) actions. Don't be surprised if something you post out into the internet comes back to bite you in the behind.

That they cannot legally use that information to deny employment is without question, but WILL they use it without your knowledge?

Remember, anything you do in public is public, and that includes the internet.
