Vacuous "intellectual property"
I suspect (or perhaps the word "hope" is more appropriate) that Google will come out on top on this. And I really do not like Google.

YouTube is very similar to a bulletin board in a sleazy laundromat right next to a copy shop. If you want to make copies from the stuff on the board, who is to say that it's not fair use (in the non-legal sense of the phrase)?

And why should you blame the laundromat management? Just because they have an increase in commerce because of the bulletin board (which happens also to have a 3x5 card encouraging people to come into the laundromat)?

Blame the copy shop for making one copy at a time? No way.

If Viacom could develop a sense of humor (admittedly a difficult concept for the "creators" of Pooty Tang), they might see that the Comedy Central clips might actually be helping the show be more popular through wider exposure. Kind of like having Coca Cola visible in a movie... it's "nice" publicity. (But in order for Viacom to admit that, they'd have to admit that they haven't covered all the bases with their public relations people. And that takes a little more humility than either PRniks and lawyers normally have.)
