That argument is wrong for two reasons, one practical and one legal. The legal reason is simply that there are specific laws that deal with pawn shops and specific laws that deal with people who relate digital content from someone else to someone else and those laws are not the same.

The practical reason is that a pawn shop owner has the ability and circumstances give him the responsibility to check if property is stolen. An Internet provider often doesn't even have the right to look at their customer's content, much less a responsibility to do so.

Google complies with the DMCA and benefits from its Safe Harbor provision. It's that simple.
