Think of it like this. If a pawn shop readily deal in stolen goods and encourages it then they are criminally responsible for dealing in stolen property even though they didn't steal the goods. Now if you the pawn shop does due dilligence in identifing what is illegal and what is not they are legal even though some stolen good do pass through thier shops.

Same with YouTube. Is YouTube removing infringing content due diligent enough. Is the content that in question actually infringing or is it false positive or legal due to fair use. Is thier policy on removing content and the action they take good enough. Viacom feels it Google is not doing enough and Google feels they are. Now they go before a court to find out who is right.
