Always go for the "deep pockets"
I stated this in another thread on this subject...

"GooTube" did not pirate the images, the uploader did. So, why doesn't Viadumb go after the true culprits? Because GooTube has the deep pockets and is only one entity that Viadumb has to go after.

Here is a solution ... track who (ip address, time/date, user id) uploaded the material and make them responsible for the illegal use of the material. That way, if a legit holder of a property finds it is being used illegally, they can request the log data, ask the content be removed, and then send a terse letter to the real infringer. If they were really pissed, they could go after this person legally. However, if Viadumb were to slap the true offender, they would be branded the "big bad corporation going after the little guy" and would suffer at the box office and other venues they play in.

Viadumb's biggest complaint over this whole thing is not the fact that their stuff is on the web, but that they would have to look at tens of thousands of sites to find the copyright infringements. They don't want to do that. They want GooTube and anyone else who is providing hosting services to do that for them, and charge them for that privilege to boot.

I think that GooTube will come out on top in this battle, as their business model is not designed to benefit directly from the content, they benefit from being able to sell ad space on a popular site, regardless of where the content comes from.
