I'm quite sure Kazza and Napster thought the same exact argument that you meantioned only to find the court too an opposite view. So when Napster claimed it should have safe harbour because the courts agree that an ISPs Newsgroup hosting that are filled with pirated content are safe then so should Naspster.

The big difference here is the Newsgroups also had tons of non infringing users same and YouTube does so I have a feeling the courts don't agree with you as they've given safe harbour to ISP who are worse for allowing pirating via news groups than YouTube ever could be.
