The courts disagree with you.
Napster and Kazza both tried to use the "safe harbor" defence and after they stopped laughing the judges said no, nada, not even a chance. Why? Because they too did little or nothing to prevent copyright infringement and the courts seen their business model depended upon that fact. In fact, both judges handed down rather scathing opinions on this very issue.
