No freedom of speach issue here
Freedom of speach doesn't give anyone the right to steal copyrighted material that Viacom spent a boatload on to produce. Yes, putting it on You Tube is theft.

While the original intent was to provide a place for unprotected clips, YouTube has an obligation to remove all copyrighted clips. If they don't put forth reasonable effort to remove the clips, they benefit from the clips and show intent to steal. Viacom probably has a good case, depending on the level of efforts YouTube engaged in.

Court costs won't break Google, but the judjement might put a serious dent in their earnings for a few years.
