Abuse of Power which I don't think the Judge has
Last I checked, I didn't think that a Judge could increase a sentence on some one who was found "Not Guilty" or acquitted of a charge.

Although I do wish they could lock up a criminal based on stupidity, but perhaps if he is out in public, Darwin will be able to take him out of the equation, hopefully without reproducing, or hurting anyone else in the same instance.
