EFF still should take to task copyright violators
which seem to outnumber misstakenly blamed users, as the EFF knows that it takes behaving on both sides to make this thing of copyright and fair use work. Viacom make amends, copyright violators make amends, and don't let YouTube be the Napster that was.

Ultimately, I blame Congress. They let big business buy fair use from out under consumers in the last few decades so that copyright seems unavoidable to infringe. Maybe when companies violate a person's IP, they can face the same assaults in court that vice versa creates. Users can send their lawyers cease and desist letters to Viacom, or those viral marketers for ripping off somebody elses posted content to make a commercial.

Send in the lawyers.
