Tha's the problem
So what do you do. I think act on the obvious stuff. I'm sure much of the child porn out there must be obvious. on the other end of the spectrum there a ton of stuff that is obviously not child porn involving minors. This case happen to fall righ smack in middle of that troublesome grey area.

I think one problem with courts today is they have no leeway in thier descisions. If they let rule one case a certain way then it set a precident that next case can use. Where is ruling on a case based on its individual merits?

In this case the judge should have been able to let the kids go. Maybe pass on bit of informative knowledge as to why they might want to avoid doing this in future, just advice not a ruling.

Then the next case happens to be a 17 year old creep doing it to make money where he films his sexual activity with as many highschool girls as possible. Then the judge should be free to rule this guy is guilty and throw the book at him. The previous case should have no bearing what so ever.
