Amazon's counter suit could be very clever.
If IBM is forced to defend itself by claiming that Amazon's patents are not valid due to being obvious and not novel then Amazon can argue that buy the same logic IBM's patents are not valid either. If IBM does not want to say that non-obvious and non-novel ideas that are patented are not valid then they would have to conceed that they are guilty of infringing on Amazon's patents. IBM now has to decided if both they and Amazon are guilty or alternately neither of them are.
