Normally I would agree
But if I read this correctly they are only covering the layout, not the function. Much like Microsft or Apple (I would imagine)have patents on their software in terms of layouts and graphics, so that some Linux distributer can not copy, pictures for picture, font for font, their desktops or design layout. I would have to guess that without such patents, some Linux (just using them as an example) offering would be an exact copy of one of these two as to try to fool the user into thinking he is purchasing Vista or OSX.
