Well, here are my 2-cents.
As long as TVU takes measures to ensure that users cannot 'reassemble' the packets of data into a file that resides on their hard drive, what is the problem?
(Now, I would like to note here that if I am not mistaken, Cable companies (a medium for distribution as well) pay content providers to distribute their materials, for the most part.)

So, setting that part which can be easily remedied aside, i don't think a distribution channel is an infringement of any kind.
This Shen guy's first order of business needs to be coming to an agreement with the channels he wishes to distribute. Same as cable, satallite, etc.
I mean come on media mafia....we have TiVo. we have video recorders, we have DVRs. We now have 'Slingbox'. So, what is the difference except that this doesnt require a one-to-one connection? You cant stop an individual from recording content.
I say that as long as Shen prevents them from reassembling the pieces into a local file, he is just another distribution channel and just needs to play the game just like DirectTV and Time Warner.
