Psyjack raises the key issue here "The companies in question will just make you accept their terms before you can have access to their services".
The question that needs to be raised is whether this issue is an unreasonable and unrelated condition of trade. It is one thing to demand the placing of ads in order to get free or low cost service, but another to demand that you compromise your right to privacy. It has trappings of "We will provide you with heat and hot water if you allow us to store weapons in your apartment" or a sign placed by a landowner "trespassers will be shot". Can the company really require things that are intrusive or unrelated or can the land owner really shoot and possibly kill someone who wanders onto their land.
Vendors should have reasonable limits placed on their requirements for service. Everyone else does, from driving your car to selling your home (cf the civil rights movement). Too much emphasis has been placed on protecting the software providers. Unless the scale is balanced with consumer rights respect for the entire system will decline and with it compliance with the law. It might be good for many of us to attend or contact the hearing group.
