Maybe we should take a page from the academic world...
When writing academic papers you are always required to cite where you got your information. To not cite a source is considered plagiarism or in other words, theft of someone else's work. Granted it's not the same as reproducing copyrighted intellectual property, but it is a very similar concept.
Perhaps video/music/media sites need to have something like this to protect their interests (allowing them to continue running) and protect the property of the source. So if you post a snippet of video from some show and you cite where it came from, etc. Then you can display it.

No matter what, they (we?) need to come up with a better system than the current laws and law suits allow. I strongly believe that in the not to distant future most movies and TV will be delivered to us via some kind of internet connection. I know there is a movie rental place (forgot the name) that allows you to download movies via the internet for a service fee of something like $10 a month.
