Putting online video to the copyright test

Failure of a solution: The problem with MySpace's solution is it doesn't account for copyrighted material being legally used. Let's say I have a band, and I put one of my songs up on my own myspace page. Under their system, it would be recognized as part of the Gracenote database, and pulled from my own site.

What about a television network deliberately leaking clips from its own shows to help hype them and bring up ratings? Again, these systems eliminate all copyrighted material, so those are out as well.
