Weak Defense
I think this article points out how weak this defense was. The text documents could have been faked. The keyboard could have been operated by another. The connection could have been from another location. Even the home phone could have been forwarded to a cell phone.

What this really points to is a need to be able to locate the computer and verify the user during internet useage. If we had this capability (ID on each processor, finger scan on user) we would then eliminate much of the fraud perpetrated on the internet. At some point in time we are going to have to accept loss of annonimity on the net.

I spent a great deal of my time writing software from this location, but if I had to absolutely prove I was here to anyone, I can see how difficult it would be.

In my opinion this case is really two defense witnesses vs. one (woman's girlfriend) because I would have to discount the former wife's testamony. I would also have to evaluate prior conduct of the husband. What did he do to justify the protective order? Women have lied to get orders in the past, but there are often pictures of bruises to document such beatings. The judge had to realize the cost of the incarceration to the public. I don't think he took the decision lightly.

In the end, he may not have been at her home on this occasion, but prior activity might have been the basis for putting him in jail for a year.
