Yes, the case seems pretty weak. Actually VERY weak. But it was also the prosecutions job to do everything that they could. Obviously they were able to poke holes in his alibi. But I am not even sure why it went to court in the first place. It even stated that the guy was nowhere around when the police showed up. There wasn't a whole lot of detail in the article so we really don't know what went on. However this is a messy divorce so either side could be lying. There had to have been a reason that the 'protective' order was in place. In the county I live in they don';t just hand them out for whatever reason. But she shouldn't have ben able to just say that she saw him and then that was that either. And why didn't they seem to notice that he didn't have access to the car that he was supposedly sitting in?
