She was either lying or she's crazy and thinks she sees him everywhere. More than enough evidence to prove he wasn't there. His lawyer should have at least gotten the phone company records to prove his brother did in fact call his mother's house at the date and time in question. Could you prove he was tlaking to his brother? No. But if you get witnesses to prove the mother was at a funeral at that time, then who else would he have been talking too?

Also the IRS would have the records on hand to see if indeed someone had checked on his brothers return. As bad as the government wants the ISPs to save records you know the government does. Sucky lawyer.
