Remember that part of the settlement of the IBM antitrust suit was that IBM would not enforce its patent rights until - well just recently.

Amazon.com is an Oracle shop. But it also uses IBM development tools like Rational. I suspect this will be settled with a technology transfer, an exchange of patents, something like that. Its kind of a none story really or perhaps the real brilliance of this story is that newbe's, the Web 2.0 kids are now on notice. They should be working with tools that cover this kind of thing either with the up front cost or clear notions of royalties. The Web 2.0 kids are also called the open-source kids by Zdnet.

Using the past as a guideline, it is not unusual to get a tool for free where the product that is developed can be distributed for free but once it becomes a commercial product you are expected to pay something to those holding patents and copyrights. It is nothing to be feared, just something to be worked into the business plan. Royalty payments.
