It wasn't mentioned in the court papers, perhaps on purpose, that these sites can indeed opt out.
The problem is they don't want to opt out. They want Google and Micrsoft, and Yahoo to index their pages but they want total control over how it is indexed and they want Google, MS, and Yahoo to pay them for indexing the pages.
It's very odd. In the US website owners are suing Google, MSN, and Yahoo becuase they didn't include their page but in Belgium they are suing them becuase they did.
