Who Owns the Email?
Businesses are required to save email, that material being used in courts of law. Hence the question about Google acting as the outsourcer. Of course this is the same model as Microsoft. Is the outsourcer required to save the email?

I have long recognized the potential of search engine companies for saving Blogs, web pages and email and using that saved data later to generate income from those investigating wrong doing, such as Medicare/ Medicaid fraud, The use of charities to launder money, campaing finance reform, organized crime etc. Privacy policies probably do not stop this kind of thing.
