YouTube totally in the clear here
Clause 512c of the DMCA makes it abundantly clear that YouTube is meeting all of their legal requirements.

The idea behind this clause was that a web hosting provider shouldn't be responsible for the actions of people who post material using their service. So if I get a free Yahoo page and swipe a graphic from someone else's website and put it on mine, Yahoo isn't responsible. All Yahoo has to do is have a policy of notification and takedown--if the owner of the graphic sees it and contacts Yahoo, they have to take it down.

Seems like a pretty fair law to me, and one that puts YouTube in the clear here.

Wow, nice to see the DMCA actually doing something good for a change.
