10 minute video
The main reason why YouTube will never see a lawsuit from a major player (MPAA for instance) is the 10 minute rule. While a 10 minute video may be whole of a few folks moment in the sun, for most content creators 10 minutes is a trailer, a free advertisement to entice folks to watch the rest of their work. Or perhaps a 10 minute commercial from a young hopeful saying "please discover me".

As for those few folks whose entire fortunes are based on the 10 minutes of fame which is being posted to YouTube. If your video is all that valuable to you then you should have no problem spending your free time agressively seeking out illegal postings and going through the deposting procedure to protect your valuable property.

Ideally copyright laws should benefit majority with a minimum of inconvienence for the minority. YouTube's business model seems to benefit far more content providers than it harms and therefore they should win in the courts. That does not say they will but based on the information to date they probably should.
