Must depend on the what terms you google with.
Have you tried googling with the ".com" suffix as well? I just tried it myself. When I did "kinderstart" I got about 104K results with what looks like a UK-based company called KinderStart at the top ( http://www.kinderstart.co.uk/ ). There are also some programs called KinderStart listed, and additonal news stories and blogs regarding the KinderStart vs Google suit (check this blog to see one person's take). KinderStart doesn't appear until page six of that search.

When I used "kinderstart.com" however, there was only one result, the site in question all by its lonesome.

Maybe KinderStart.com can sue KinderStart.co.uk for stealing their name. Then they can go after those groups with KinderStart programs on the same grounds, and those news and blog sites for posting stories about KinderStart. Once all those leeches are gone, KinderStart.com will be back at Google's #1 spot.
