While there is no simple solution to this of idiot legislators trying to pass laws for something that is way over their heads, there is a way to strike back (besides voting the rascals out of the office):

Encrypt everything.

Okay, so a law enforcement agency intercepts your private transmission. If it's at least PGP encrypted, it will be really expensive for them to try to break that encyption. So even if they have your bits, it'll cost 'em far, far more to see the latest joke you've forwarded your friends.

The Vontage and VOIP stuff: how about encrypting handsets for private conversations? Or perhaps a software add-on that you load and it does the job for you. Sounds like a great business opportunity to me.

The bottom line is that you make it so expensive for the bureaucrats to listen in that they won't even bother.
