Apple's criticism of the law was correct and that's
why the French legislators gave in.

Apple said that if interoperability were required then people
would be copying music illegally and the law would actually
encourage piracy. Additionally, it would reduce competition in
the the DRM business because everyone would use only one
kind. Finally, France's law would reward mediocrity and destroy
the incentive for product innovation and excellence.

MS used the "kill innovation" card in its legal defenses all the
time but it couldn't prove how. Apple rightly proved that the
iPod + iTunes product is so far superior that the French
government has no right to take away one of their competitive
advantages.
