Hey, a guy walks into your store and asks for Heinz ketchup, and you sell
him another brand, are you in violation of trademark infringement? If you go to a travel agent asking about a specific vacation spot, and he sells you a different, similar vacation spot where he gets a commision, is he guilty of trademark infringement?

Seems the only reason they think they have a case is because it is automated? If you automate a recommendation system does it suddenly become illegal?
