There is actually no universally definition of spam. As per your claim,
Sending e-mail is not illegal, but mass unsolisited e-mails would be named spam by most people (except maybe spammers' lawyers). And, guess what... These "most people" are quite right, as it's them who came up with the term anyway, and it has not been legislatively defined yet.
IOW, there is a popular notition of what spam is, but there is no legally-accepted strict definition.

P.S. Similar example is "spyware": everyone defines it in the most convenient for him/her-self way, but most people will agree on whether a sertain sw component is spyware (again, except for most spyware companies' lawyers).
