You have it completely wrong! Read further...
The EC is attacking Microsoft for leveraging its monopoly
position to kill competition. The proof: MS bundled Windows
Media Player, removing RealPlayer as a viable option for OEM's
distributing computers with Windows installed as the OS. The
RealPlayer market share crumbled as a result.

The reason France cannot put this law into effect is that the EC
will eventually support a claim from Apple that France is forcing
it to reveal trade secrets and therfore kill its competitive
advantage in the marketplace, something that EU rules do not
allow.

why does MS have to reveal its codes? Because it was proven in
court that MS PURPOSEFULLY held back some API functionality so
that its own software ran better than competing software could
run. That is illegal under EU rules. Ford may not make a car
that runs better on Ford parts than it would on parts made by
competitors. MS was found in both the server market and in the
API market to give its own products better functionality because
of code. That is not a problem is if you do not have a monopoly.
Apple does not have a monopoly with iPod/iTunes getting only
78% of the marketplace. MS, at 90 - 95% of the PC market, does
have a monopoly, therefore, it can leverage its position to put
others out of business. That is illegal both here and in every
major industrialized world. MS has been found guilty in S Korea,
Japan, the US and Europe for anti-competitive business
practices.

Apple and Sony would have jointly sued France and won for
copyright infringement. Plus, the digital online music business
is not nearly as popular here as in the UK and US. People here
still steal most of their music through P2P.
