I find the USPTO too confusing
I'd love to argue with you, but honestly, I find the workings of the USPTO way too byzantine to really get a handle on. I mean, look at the Eolas patent, that one certainly should have been struck down, but it's still standing. So from what I've read, I think most of these patents are of similar quality, but who knows what a court will do with them?

And MS settling is not necessarily an admission of anything. It could be due to (allegedly) MS stealing and using actual Burst technology (rather than just infringing on their patents), or it could just be a simple economic decision--paying $60M was less than it would have cost to fight it in court. Apple is in a different position, as Burst wants a percentage of their revenue and future revenue as well, which probably means more than court costs, when taken over the long haul.
