Again, you missed the point
Microsoft was in discussions about Burst's technology before they made changes to their Media Player. They were working with Burst about how changes could be made to Media Player. They told Burst to take a hike and integrated Bursts technology into their Media Player. This is why its referred to as technology theft.

Burst is now saying Apple is in violation of their patents. Apple was not in discussions with Burst about implementing their technology prior to Apple modifing software. Burst just thinks that Apple's software implementation is in violation of their own patents.

Like I said, two different cases, and I believe will result in two different outcomes. You're comparing Apples to oranges. wink
